Lenovo Social Competition - Terms & Conditions

CONDITIONS OF ENTRY

The Lenovo Social Competition (Competition) commences at 6:00 am (EDST) on Friday, 14 October, 2012 and ends at 11:59 pm (EDST) on Sunday, 14 October, 2012 (Competition Period). The Promoter of the Competition is Lenovo (Australia and New Zealand) Pty Limited ABN 70 112 394 411 of Level 10, North Tower, 1-5 Railway Street, Chatswood NSW 2067. Information on "How to Enter" and prize details form part of these Conditions of Entry ("Conditions"). Participation in this competition is deemed acceptance of these Conditions.

Entry eligibility

This Promotion is only open to Australian and New Zealand residents currently residing in Australia or New Zealand, with a valid email address and street address. Entrants must submit an entry or entries in accordance with these Conditions. Only entrants over the age of 18 years may enter.

Employees (and their immediate families) of the Promoter and agencies associated with this Competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete or indecipherable entries or entries not completed in accordance with these Conditions will be deemed invalid.

The Competition is a game of skill. Chance plays no part in determining the winners. All valid entries will be individually judged according to their skill, originality and creative merit and the entry judged by the Promoter to be the best will win.

The Competition is in no way sponsored, endorsed or administered by, or associated with Twitter, Facebook, Google, or Foursquare. Entrants are providing their information to the Promoter and not to Twitter, Facebook, Google or Foursquare. Each entrant completely releases Twitter, Facebook, Google or Foursquare from any and all liability.

The Promoter does not charge a fee for entering into the Competition. However, costs of accessing the internet and the promotional website is the entrant's responsibility and may be dependent on the internet service provider used.

How to enter

To enter, entrants must tell the Promoter via, Facebook, in 25 words or less their response to the competition question. Only entries submitted using the dedicated Facebook competition app will be considered by the Promoter. Entries will be considered for the nominated prize.

Entries must be posed as a statement. Questions, phrases and any non-statements will not be considered as valid. Complete the fields requiring the entrant's age, name, email and street address.

Multiple and varied entries per person will be accepted. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted from that source and by those entrants invalid. All entries must be received within the Competition Period. Entries are deemed to be received at the time they are received by the Promoter's database and not at the time of submission by the entrant. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, and communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

How winners are determined

Valid entries (as determined by the Promoter) will be judged based on creativity and originality of the entrant's response as assessed by the Promoter and/or any agents acting on the Promoter's behalf.

Entries will be judged at 4:00 pm on the Monday after the competition period at the office of the Promoter in Chatswood. All times indicated are based on EDST. Winners will be notified via email. The Promoter will determine one winner from all received but not yet assessed entries which comply with these Conditions (as determined by the Promoter or its nominee in its sole discretion). The Promoter's decision will be final and no correspondence will be entered into.

Prizes

Prize value is correct at time of printing but no responsibility is accepted for any variation in the value of any prize. The prize is as follows: 1 x Lenovo X1 Carbon (total prize pool valued at AUD$1,999 RRP). Prizes are not transferable or exchangeable and cannot be taken as cash. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter subject to approval by regulatory bodies if required. The Prize will only be awarded to the winner or their parent/guardian following any validation and verification that the Promoter requires in its sole discretion.

Any winner that accepts a prize agrees, at the Promoter's request, to participate in any and all promotional activity (such as publicity and photography) involved in the winning of any prize, and they consent to the Promoter using their name and image in promotional material relating to the Competition. Competition winners will be announced on the last day of the specified month and, if applicable, contacted by phone and/or email. Winners must respond within seven days to claim their prize. Failure by a winner to claim a prize within seven days will result in a new winner being determined in accordance with these Conditions. If the Promoter is unable to contact the winner within seven working days to claim fulfilment of the prize, that winner will forfeit the prize in its entirety and it shall be awarded to next best valid entry selected. The Promoter will not be liable for a winner that cannot be contacted within this time and no correspondence will be entered into.

General

If for any reason any aspect of this Competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorized intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory, if required.

Nothing in these Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act ("Act"), as well as any other implied warranties under the Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of:

  • any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
  • any theft, unauthorised access or third party interference;
  • any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  • any variation in the prize value/s stated in these Conditions;
  • any tax liability incurred by a winner or entrant;
  • use of or taking of a prize;
  • any equipment malfunction or programming malfunction, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website, software failure;
  • any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any materials in the Promotion; and
  • participation in the Competition.

The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this competition, entrants consent to the storage of their personal information on the Promoter's database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the entrant via electronic messaging. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the above address. All entries become the property of the Promoter.

All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this Promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. By entering the Promotion, each entrant agrees to the Promoter using their entry for printing, broadcast, publicity, commercial and promotional purposes without compensation, including but not limited to the possible development and commercialization of the entrant's idea and agrees that the Promoter will own all intellectual property rights, including copyright, in any such material and agrees not to object to any such use on the basis of any moral right. Entrants agree that they are fully responsible for the content ("Content") of the entry they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender or otherwise unsuitable for publication; (b) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (c) their Content shall not contain viruses or cause injury or harm to any person or entity; and (d) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Without limiting any other terms herein, the entrant indemnifies the Promoter for any breach of the above terms.
